La controversia entre los precitados despachos tuvo su origen en las diferentes interpretaciones sobre el factor territorial.
Ambos juzgados presentaron una serie de argumentaciones relacionadas con el lugar donde se presentó y tuvo sus efectos la vulneración de derechos alegada por la parte demandante.
Se dirimió el conflicto con la remisión del expediente al Juzgado Penal del Circuito de Saravena para que, de manera inmediata, tramite y adopte la decisión a que haya lugar.

- PRIMERO. DEJAR SIN EFECTOS el auto proferido el 24 de octubre de 2024 por el Juzgado Penal del Circuito de Saravena en el marco del trámite de la acción de tutela promovida por el señor
- Segundo. Lizandro Mayorga.
- SEGUNDO. REMITIR el expediente ICC-4839 al Juzgado Penal del Circuito de Saravena (Arauca) para que, de manera inmediata, tramite y adopte la decisión a que haya lugar.
- TERCERO. Por la Secretaría General de esta corporación, COMUNICAR la presente decisión a la parte demandante, al Juzgado 4° Administrativo del Circuito de Arauca y al Juzgado Penal del Circuito de Saravena (Arauca).
